By accessing or using the services provided by J2 Scaling ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
J2 Scaling provides marketing consulting, paid advertising management, marketing automation, funnel strategy, content creation, and related growth services to businesses. The specific scope of services provided to any client will be defined in a separate service agreement or statement of work.
As a client, you agree to:
Payment terms, fees, and billing schedules are outlined in your individual service agreement. Unless otherwise agreed in writing:
Upon full payment of all fees owed, J2 Scaling assigns to you ownership of all custom deliverables created specifically for your account, including ad copy, landing pages, and marketing materials. J2 Scaling retains ownership of its methodologies, systems, templates, and proprietary processes used to deliver services.
Both parties agree to keep confidential any non-public information shared in the course of the engagement. J2 Scaling will not share your business data, campaign results, or proprietary information with third parties without your written consent, except as required by law or as necessary to deliver services (e.g., sharing access with a platform partner).
While J2 Scaling applies industry best practices and significant expertise to every engagement, we cannot guarantee specific revenue outcomes, lead volumes, or return on ad spend. Marketing results depend on many factors outside our control, including market conditions, product-market fit, and client responsiveness. Any projected results shared during sales conversations are estimates based on prior experience, not guarantees.
To the maximum extent permitted by law, J2 Scaling's total liability for any claim arising out of or relating to our services shall not exceed the total fees paid by you in the three (3) months preceding the claim. In no event shall J2 Scaling be liable for indirect, incidental, consequential, or punitive damages.
Either party may terminate services with 30 days written notice unless a different notice period is specified in your service agreement. Upon termination, you are responsible for all fees incurred through the termination date. J2 Scaling will provide a reasonable transition of materials and account access upon request.
These Terms of Service are governed by the laws of the United States. Any disputes arising under these terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
We reserve the right to update these Terms of Service at any time. We will notify active clients of material changes via email. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
